Income-tax notice under section 139(9)

A 139(9) intimation says the return already filed has a defect. Future Tax reads the defect named on that PDF before anything is sent back. The office is at 515 Trichy Road, Singanallur.

Quick answer

This page is a defective return under section 139(9). Processing under section 143(1) is a different intimation. A late or corrected filing stays on the belated and revised page. Do not send the income-tax password in chat. Call +91 94454 38387.

What the intimation is asking

The PDF names the defect. A return in the wrong form can be one of them. Do not treat every mismatch as a 139(9). A difference with Form 16 or AIS can also appear later in a 143(1) intimation. Read the section printed on the PDF before a response is prepared.

The date on the intimation

Section 139(9) provides fifteen days from the intimation, or a further period if one is allowed. Use the date on the intimation. A date copied from a 143(1) note, or from another client’s notice, is not this date.

If the defect is not removed

If the defect is not removed within that time, the return can be treated as invalid, as if it was not filed. Whether a belated return is still open is decided on the portal. That check is on the belated and revised page. A revised return is not automatically the response the intimation asks for. Follow the response the PDF allows.

Before a response is sent

  1. Send the 139(9) PDF, the acknowledgement, and the paper that answers the defect named on the PDF.
  2. The desk says what the intimation asks for, and what is still missing.
  3. You approve the response, or the corrected return, before it is sent.
  4. If a return is filed again, you complete e-verification yourself: Aadhaar OTP, net banking, a bank or demat EVC, or a signed ITR-V as the portal instructs.

Income-tax work starts at ₹2,000 on the Coimbatore income-tax page. A defective-return file costs more when the papers are incomplete. The quote is confirmed before a response is sent. The first discussion is free. The length depends on the file.

Common questions

Is a 139(9) intimation the same as 143(1)?

No. Section 143(1) is the processing result of a return. Section 139(9) says the return is defective and asks for that defect to be removed.

How long do I have to respond?

Section 139(9) provides fifteen days from the intimation, or a further period if one is allowed. Use the date on the intimation. Do not use a date copied from another notice.

What if that date is missed?

The return can be treated as invalid, as if it was not filed. Whether a belated return is still open depends on the date on the income-tax portal.
